Part 1 sets out the rules for using this website. Part 2 — User Agreement (Desktop Application) governs the PromptSense desktop application. The software License (grant and restrictions) is published separately.

Part 1 — Website (promptsense.eu)

1. Website Terms of Use

By accessing or using promptsense.eu ("the Website"), you agree to be bound by these terms. If you do not agree, please do not use the Website.

Permitted Use

The Website is provided for informational purposes only. You may access and use the Website for lawful, personal, or commercial informational purposes.

Prohibited Use

Scraping, crawling, or automated data extraction without prior written consent
Attempting to disrupt, overload, or compromise the Website infrastructure
Using the Website to distribute malware, spam, or unlawful content
Misrepresenting your identity or affiliation with Bootstrap OÜ
Any use that violates applicable Estonian, EU, or international law

2. Intellectual Property

All content on this Website and within the PromptSense Desktop Application — including but not limited to text, graphics, logos, icons, user interface elements, and software code — is the intellectual property of Bootstrap OÜ or its licensors and is protected under Estonian and European Union copyright law, as well as international intellectual property treaties.

PromptSense Name and Brand

The name "PromptSense", the PromptSense logo, and associated brand elements are proprietary to Bootstrap OÜ. Unauthorised use of these marks for commercial purposes or in a way that implies endorsement by Bootstrap OÜ is prohibited.

Third-Party Components

The PromptSense Desktop Application and this Website incorporate open-source software components. These components are used in accordance with their respective licences. A representative set of project names, each linking to its source repository, is published on the License page.

3. Disclaimer of Warranties — Website

The Website and the PromptSense Desktop Application are provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Website or Desktop Application will be uninterrupted, error-free, or free of viruses
Warranties as to the accuracy, completeness, or timeliness of any content on the Website
Warranties regarding the suitability of AI-generated outputs for any specific use

AI-generated content produced by the Desktop Application is provided for informational and productivity purposes only. It does not constitute legal, medical, financial, or professional advice of any kind. You bear sole responsibility for how you use AI-generated outputs.

4. Limitation of Liability — Website

To the maximum extent permitted by applicable law, Bootstrap OÜ and its founders, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or inability to use the Website or Desktop Application
Any reliance on content or AI outputs from the Desktop Application
Unauthorised access to or alteration of your data
Any bugs, errors, or inaccuracies in the Desktop Application or Website
Any interruption or cessation of the Website or Desktop Application

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Estonian or EU law.

5. External Links

The Website may contain links to third-party websites or resources. These links are provided for convenience only. Bootstrap OÜ has no control over the content or availability of external sites and accepts no responsibility or liability for them. Linking to a third-party site does not imply endorsement by Bootstrap OÜ.

6. Governing Law and Jurisdiction — Website

These website terms and any disputes arising out of or in connection with use of the Website shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, unless mandatory EU consumer protection law grants you the right to bring proceedings in your country of habitual residence.

For disputes involving consumers resident in the European Union, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

7. Changes to These Website Terms

Bootstrap OÜ reserves the right to update or amend these website terms at any time. Changes will be effective upon posting to the Website. The date of the most recent update is shown on the Terms page. Continued use of the Website after changes are posted constitutes acceptance of those changes.

Part 2 — User Agreement (Desktop Application)

The following sections govern installation and use of the PromptSense Desktop Application on your device.

This User Agreement governs your use of the PromptSense Desktop Application. By installing or using PromptSense you agree to these terms. This Agreement should be read alongside the License, which defines what you are permitted and not permitted to do with the Desktop Application.

1. User Responsibilities

You are solely responsible for:

All content you input into the Desktop Application
All decisions and actions taken based on the Desktop Application's outputs
Ensuring your use complies with applicable laws and regulations in your jurisdiction
Maintaining the security of your own system and data
Verifying the accuracy of any information produced by the Desktop Application
Ensuring you have the right to process any data you input, including third-party and personal data

2. Disclaimer of Liability

Bootstrap OÜ and its developers shall not be held liable for:

Any errors, inaccuracies, or omissions in the Desktop Application's outputs
Any decisions made based on the Desktop Application's responses
Any illegal or unauthorized use of the Desktop Application by you or others
Any direct, indirect, incidental, special, or consequential damages resulting from your use
Any data loss, corruption, or security breaches
Any consequences of using AI-generated content without independent verification
Any third-party claims arising from your use of the Desktop Application

You use this Desktop Application entirely at your own risk.

3. No Warranty

The Desktop Application is provided "as is" without warranty of any kind, whether express or implied. Bootstrap OÜ makes no representations or warranties regarding:

Accuracy, completeness, or reliability of outputs
Fitness for any particular purpose
Uninterrupted or error-free operation
Security of the Desktop Application or your data

4. AI-Specific Disclaimers

This Desktop Application uses artificial intelligence. By using it, you acknowledge:

AI models can produce incorrect, biased, or inappropriate outputs
AI outputs do not constitute professional legal, medical, financial, or technical advice
AI-generated content may inadvertently resemble copyrighted material
All AI outputs require independent human review and verification before reliance

5. Indemnification

You agree to indemnify and hold harmless Bootstrap OÜ, its developers, officers, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

Your use or misuse of the Desktop Application
Your violation of this Agreement
Your violation of any applicable law or third-party right

6. Data and Privacy

While this Desktop Application processes data locally on your device:

You remain responsible for ensuring you have the right to process any data you input
You are responsible for complying with applicable data protection laws (e.g., GDPR)
You must not input personal data of others without proper legal basis or authorization
Bootstrap OÜ does not collect, transmit, or store your data through the local Desktop Application

7. Termination

7.1 Automatic Termination
This license terminates automatically and immediately upon any breach of the restrictions in the License.

7.2 Termination for Cause
Bootstrap OÜ may terminate this license immediately without notice if:

The Desktop Application is used for illegal or unlawful purposes
The Desktop Application is used in violation of export controls, sanctions, or trade restrictions
Use creates legal liability, reputational harm, or financial loss for Bootstrap OÜ
Use violates third-party intellectual property, privacy rights, or other legal obligations

7.3 Termination at Discretion
Bootstrap OÜ reserves the right to terminate any license at its sole discretion.

7.4 Effect of Termination
Upon termination, you must immediately cease all use of the Desktop Application and destroy all copies in your possession.

8. Prohibited Uses

In addition to the restrictions in the License, you may not use PromptSense for:

Any illegal activity or purpose under applicable law
Creating, distributing, or facilitating malware, viruses, or harmful code
Harassment, abuse, threats, hate speech, or harmful conduct toward others
Fraud, deception, identity theft, or misrepresentation
Unauthorized access to computer systems or networks
Violating intellectual property rights, patents, trademarks, or copyrights of third parties
Any purpose that violates sanctions, export controls, or trade embargoes

9. Governing Law

This Agreement is governed by the laws of the Republic of Estonia. Any disputes shall be resolved exclusively in the courts of Tallinn, Estonia.
